Article 1 (Purpose and Application)
- These Terms and Conditions define the conditions for using the “Blog Importer Managed Import System” (hereinafter referred to as “the Service”) provided by us.
- Users who use the Service are deemed to have agreed to all provisions of these Terms at the time of making a request on the system.
Article 2 (Service Content and Scope)
- The Service provides “managed migration” by analyzing data provided by the user (XML files, etc.) and migrating it to the specified Shopify store.
- The scope of work is limited to data conversion and import based on our system specifications. Post-import design adjustments, theme customization, publishing draft articles, technical consulting regarding Shopify or WordPress operations, and other auxiliary tasks are outside the scope of support.
- We do not provide any support for Shopify specifications or the operation of other third-party apps. Please contact the respective app developers for such inquiries.
Article 3 (Provisions for Free Test Import and Support)
- Restrictions on Test Import: If we determine that a user is intentionally re-requesting a test import for purposes such as resetting the maximum number of questions, we may automatically cancel the request and refuse future service provision.
- Designated Communication Channel: Questions and inquiries regarding the Service must be made using the message function within the dedicated system. As a general rule, we do not respond to inquiries made via direct email or telephone.
- Maximum Number of Questions: To ensure the smooth progress of operations, a limit is set on the number of free questions.
- Response after Reaching the Limit: Once the specified limit is reached, we will not respond to further free questions, except for issues arising from our negligence or system defects. If further consultation or preliminary investigation is required after reaching the limit, you may be required to purchase additional paid support (e.g., “Additional Question Ticket”), or we may refuse to provide the Service.
Article 4 (Pricing and Payment)
- Fees consist of a base fee and a usage-based fee depending on the number of imports and options selected. Payment must be made through Stripe.
- Formation of Agreement: Users shall thoroughly review the test import results (at Status 3) before entering into the final contract. By completing the payment through Stripe, the user is deemed to have agreed to the quality and specifications of the test results, and no further objections regarding data structure or import content will be accepted.
- Non-Refundable Principle: After payment is completed (transition to Status 1), no cancellations or refunds will be accepted for any reason due to user convenience, except in cases where providing the Service becomes physically impossible due to our system failure, etc.
Article 5 (User Obligations and Preparation)
- When using the Service, the user is obligated to perform the following preparations and provide necessary information:
- Accurate export and provision of source data (XML files, etc.).
- Prompt review of content after completion of the test import.
- Approval of collaborator requests to the Shopify store.
- If using metafields, prior “definition” creation on the Shopify side.
- Maintenance of Image Access: In order to normally perform the automatic migration of image data within articles, the user is responsible for maintaining public access (without Basic authentication, IP restrictions, etc.) to the source website and image data until the Service’s import work is completely finished. Re-work required due to images being unreachable because of user circumstances will be subject to additional fees.
Article 6 (Data Handling and Confidentiality)
- Data provided by the user (XML files, etc.) and Shopify store authentication information will be used solely for the purpose of providing the Service.
- Uploaded files and generated data will be automatically and completely deleted from our server 30 days after the completion of the import.
- The user guarantees that the data provided does not contain content that infringes on the copyrights of third parties or information that violates personal information protection laws.
Article 7 (Non-Warranty and Disclaimer) [Most Important Item] Regarding the use of the Service, we make no warranties of any kind and assume no responsibility for damages arising from the following:
- No Guarantee of Completeness: The Service does not guarantee that the exact same display or structure as the original website will be reproduced on Shopify. WordPress-specific shortcodes, dynamic content, automatic addition of paragraph (
<p>) tags, etc., may result in missing conversions or layout issues. - URL and SEO Constraints: Due to Shopify’s specifications, automatic redirect settings from old URLs containing parameters such as
?pid=123are not supported. We make no guarantee regarding the maintenance of SEO rankings through URL changes or redirect settings. - Metafield Constraints: Metafield migration is limited to “single-type” only. Batch migration of data with list formats or complex JSON structures is outside the scope of warranty. The user is responsible for configuring the display settings of the migrated data on the front-end (theme).
- Responsibility for Backup: Since the import process may affect existing data in the Shopify store, users must take a backup in advance at their own responsibility.
- Restrictions on Re-work: “Re-imports due to customer convenience” after execution will be subject to additional fees. Furthermore, the user is responsible for any deletion work of imported data.
Article 8 (Automatic Completion of Contract due to Loss of Contact) If “30 days” pass after payment completion without the user providing Shopify store connection information (collaborator request code, etc.) or without our request for cooperation being approved, we may deem the import work as completed and terminate the contract. In this case, no fees received will be refunded.
Article 9 (Limitation of Liability) Even if damages occur to the user due to our gross negligence, the limit of liability for damages we assume shall be the usage fee (migration cost) paid by the user to us for the Service.
Article 10 (Prohibited Matters) Users shall not engage in the following acts when using the Service:
- Acts that place an excessive burden on the system’s server or acts of unauthorized access.
- Uploading files containing malware or malicious programs.
- Tampering or reverse-engineering the source code of our system.
- Other acts that we deem inappropriate.
